Welcome to Bespoke Undertakings, LLC. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our website or services, you affirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you do not agree to these Terms, you may not use our website or services.

2. Description of Services

Bespoke Undertakings, LLC provides post-cremation consultation, coordination, and memorial services. Our services include:

• Consultation services for families who have cremated remains in their custody
• Coordination of permanent placement in cemeteries or memorial locations
• Assistance with veteran burial benefits and VA coordination
• Memorial product selection and procurement
• Ceremony planning and on-site coordination
• Cemetery paperwork and record management

3. Service Engagement and Fees

Consultations:

• Initial consultations are subject to a $295 fee
• Consultations may be conducted at our Denton studio, virtually, or at a location of your choice
• Consultation fees are non-refundable once the consultation has been conducted

Additional Services:

• On-site placement coordination: $495
• Additional services are quoted individually based on scope and complexity
• All fees will be clearly disclosed in writing before services are rendered
• Payment is due prior to service delivery unless otherwise agreed in writing

4. Scope of Services and Limitations

Our services are limited to consultation, coordination, and guidance for families who already possess cremated remains. We:

• Do NOT handle, transport, or take custody of human remains
• Do NOT provide cremation or funeral directing services
• Do NOT operate as a funeral establishment under Texas law
• Act solely as consultants and coordinators for post-cremation services

5. Client Responsibilities

When engaging our services, you agree to:

• Provide accurate and complete information about your situation and needs
• Have legal authority and custody of the cremated remains in question
• Pay all fees according to the agreed schedule
• Comply with all cemetery rules, regulations, and requirements
• Obtain any necessary permits or authorizations for placement
• Respond promptly to communications regarding your services

6. Third-Party Services

We coordinate with third-party service providers including:

• Cemeteries and memorial parks
• Veterans Affairs offices
• Memorial product vendors
• Ceremony officiants and venues

While we carefully select and coordinate with these providers, we are not responsible for their actions, errors, or omissions. Any disputes with third-party providers must be resolved directly with those entities.

7. Cancellation and Refund Policy

Consultations:

• Cancellations made more than 48 hours before scheduled consultation: Full refund
• Cancellations made less than 48 hours before scheduled consultation: No refund
• Consultations already conducted: No refund

Additional Services:

• Services not yet performed may be cancelled with appropriate notice
• Refunds for cancelled services will be provided minus any costs already incurred
• Services already rendered are non-refundable

8. Professional Licensing

Joseph D. Bell, the principal of Bespoke Undertakings, LLC, maintains active funeral director licenses in:

• Texas (#120653)
• South Carolina (#4665)
• Washington (#25021913)

These licenses are maintained for professional expertise and credibility. However, Bespoke Undertakings' services operate outside the scope of traditional funeral directing as our business model focuses exclusively on post-cremation consultation and coordination for families who already have custody of cremated remains.

9. Disclaimers and Limitations of Liability

No Guarantees: While we strive to provide excellent service, we cannot guarantee specific outcomes, including but not limited to:

• Approval of veteran benefits applications
• Cemetery acceptance of placement requests
• Availability of specific memorial products or services
• Timeline for completion of cemetery or government processes

Limitation of Liability: To the maximum extent permitted by law, Bespoke Undertakings, LLC's total liability for any claims arising from our services shall not exceed the amount of fees paid by you for the specific services giving rise to the claim.

No Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, emotional distress, or loss of business opportunity.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Bespoke Undertakings, LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Website Use

When using our website, you agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the website's operation
• Transmit viruses, malware, or harmful code
• Collect information about other users
• Impersonate any person or entity

12. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Venue: Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Denton County, Texas.

Informal Resolution: Before filing any legal action, you agree to first contact us to attempt to resolve the dispute informally.

14. Indemnification

You agree to indemnify, defend, and hold harmless Bespoke Undertakings, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your provision of inaccurate or incomplete information

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Bespoke Undertakings, LLC regarding your use of our services.

18. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

19. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
